Terms of Service

1. Acceptance of Terms; Electronic Consent

By accessing, browsing, or using bazaar-cat, you agree to these Terms of Service and any referenced policies (including our Returns and Refunds and Privacy terms). bazaar-cat is an online store operated by bazaar-cat where you can browse and purchase products. If you do not agree with these terms, do not use the store. Your use of the platform constitutes your electronic signature and binding acceptance of these Terms under applicable electronic signature laws, including the U.S. E-SIGN Act (15 U.S.C. § 7001 et seq.), the Uniform Electronic Transactions Act (UETA) as adopted in U.S. states, and Canada's Personal Information Protection and Electronic Documents Act (PIPEDA) and provincial electronic commerce laws. You represent that you have the legal capacity and authority to enter into this agreement, and that any purchase you make is for yourself or as an authorized gift.

2. Eligibility and Access

You must be at least the age of majority in your jurisdiction to create an account and place orders. You are responsible for keeping your account credentials secure and for all activity performed under your account.

3. Acceptable Use and Prohibited Conduct

You agree to use the store only for lawful personal shopping and to:

• Provide accurate shipping and account information.
• Not attempt to bypass checkout or payment controls.
• Not access other customers' accounts, orders, or data.
• Not introduce malicious content or attempt to disrupt the service.

You agree not to:

• Submit fraudulent, fictitious, or duplicate orders.
• File a chargeback, payment dispute, or reversal with any bank, card network, or payment processor before first contacting bazaar-cat and allowing us to resolve the issue internally.
• Reverse engineer, decompile, disassemble, scrape, or attempt to derive source code, pricing, or supplier data from the platform.
• Use automated scripts, bots, or crawlers to access the platform, except as expressly authorized.
• Resell, redistribute, or commercially exploit products or data obtained through the platform outside bazaar-cat's business.
• Use the platform to violate any applicable U.S., Canadian, or other law, including export controls, sanctions, anti-bribery, and anti-corruption laws.

4. Orders and Fulfillment

When you place an order, you authorize us to charge your payment method and fulfill the order through our suppliers. We reserve the right to cancel or modify orders before fulfillment, including for pricing errors or stock issues (see Section 11). Your order and payment history is saved to your account.

5. Payments

Payments for approved procurement orders are processed by Stripe. By initiating a payment you authorize the associated charge.

6. Returns and Refunds

All products are sourced through CJ Dropshipping. Our return policy mirrors CJ's after-sales dispute terms to ensure every claim can be passed through to the supplier. No returns or refunds are guaranteed beyond what CJ approves.

6.1 Eligible Claims (Full Refund or Replacement)

You may request a refund or replacement within 7 days of delivery only for the following supplier-confirmed issues:

• Item arrived damaged or broken.
• Wrong item received (different from what was ordered).
• Product quality defect or malfunction on arrival.
• Missing items from a multi-item shipment.
• Package lost in transit (confirmed by the carrier).

All claims must include clear photos or video of the product, packaging, and shipping label, submitted via the Contact page or to bazaar.catofficial@gmail.com. Claims without evidence will not be processed.

6.2 Non-Eligible Claims (No Refund or Return)

The following are not eligible for refund, return, or exchange:

• Buyer remorse, changed mind, or no longer needed.
• Wrong size, color, or model selected by the requester (verify specifications before ordering).
• Items that have been opened, used, assembled, or installed.
• Damage caused by misuse, improper handling, or normal wear after delivery.
• Requests submitted after the 7-day claim window.
• Clothing, footwear, and personal-care items for hygiene reasons once opened.

6.3 Resolution Process

• Keep-and-refund: For minor defects or cosmetic issues, we may offer a partial refund while you keep the item — this avoids costly return shipping and is CJ's preferred resolution.
• Resend: For damaged or wrong items, a replacement may be sent at no cost once the claim is approved by CJ.
• Return to China: If a physical return is required, the item must be shipped back to CJ's warehouse in China within 30 days of delivery. Return shipping costs for preference-based issues are borne by the requester. Items must be unused and in original packaging.
• Refund timeline: Approved refunds are issued to the original payment method within 7–14 business days, subject to CJ's processing and Stripe's settlement cycle.

6.4 Shipping and Duty Non-Refundability

Original shipping charges, customs duties, and import taxes are non-refundable except in cases where CJ confirms a shipping error on their end. Return shipping to China is the requester's responsibility unless CJ explicitly authorizes a prepaid label.

6.5 Dispute Escalation

All disputes must be opened through bazaar-cat's internal channel first. We will file the claim with CJ on your behalf. Opening a chargeback or payment dispute directly with Stripe or your bank before contacting us may result in account suspension, as CJ requires all disputes to be processed through their platform.

7. Service Availability

The platform is provided on an "as available" and "as is" basis. bazaar-cat may modify, suspend, or discontinue features at any time with or without notice. We do not guarantee uninterrupted, error-free, or secure access to the platform.

8. Disclaimers and No Warranties

To the fullest extent permitted by law, bazaar-cat disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Product descriptions, images, pricing, and stock levels are provided by third-party suppliers and may be inaccurate or change without notice. We do not warrant that any product will meet your expectations or be free of defects. All products are sourced and fulfilled by third parties (CJ Dropshipping and its suppliers), and bazaar-cat is not the manufacturer or direct seller of any product.

9. Limitation of Liability

To the maximum extent permitted by law, bazaar-cat, its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or business, arising out of or related to your use of (or inability to use) the platform or any product purchased through it. Our total aggregate liability for any claim shall not exceed the amount you paid for the specific product or order giving rise to the claim. You acknowledge that the store is provided as a convenience.

10. Third-Party Services and Suppliers

The platform integrates with third-party services including CJ Dropshipping (product sourcing and fulfillment), Stripe (payments), and shipping carriers. bazaar-cat is not responsible for the acts, omissions, delays, or policies of these third parties, including supplier stockouts, shipping delays, customs holds, lost packages, or product quality issues beyond our control. Any dispute with a supplier is subject to that supplier's policies and our Returns and Refunds section above.

11. Pricing, Errors, and Order Accuracy

Prices, descriptions, and availability are subject to change without notice. We reserve the right to correct errors in pricing, product information, or order details, and to cancel or modify any order (including approved requests) before fulfillment. If an order is cancelled due to an error, any amount charged will be refunded in full, which constitutes your sole remedy. We are not obligated to honor pricing or terms resulting from typographical, technical, or system errors.

12. Indemnification

You agree to indemnify and hold harmless bazaar-cat, its officers, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your misuse of the platform, your violation of these Terms, your submission of inaccurate or fraudulent procurement requests, or your breach of any law or third-party right.

13. Force Majeure

bazaar-cat shall not be liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, labor disputes, supplier failures, carrier disruptions, customs or governmental actions, cyberattacks, internet or infrastructure outages, or any other force majeure event.

14. Confidentiality and Data

bazaar-cat may collect, store, and process usage data and order history for operational, security, and service-improvement purposes. You consent to such processing as part of using the store.

15. Account Suspension and Termination

bazaar-cat may suspend, restrict, or terminate your account at any time, without notice, for violation of these Terms, misuse of the store, or fraudulent activity. Upon termination, your right to use the platform ends immediately. Sections that by their nature should survive termination (including liability, indemnification, confidentiality, and dispute provisions) remain in effect.

16. Governing Law, Arbitration, and Class Action Waiver

Governing law. These Terms and any dispute arising out of or related to them or to the platform shall be governed by the laws of the Province of Ontario, Canada and the federal laws of Canada applicable therein, without regard to conflict-of-law principles, for users located in Canada; and by the laws of the State of Delaware, U.S.A., without regard to conflict-of-law principles, for users located in the United States. For users located outside Canada and the United States, the laws of the Province of Ontario, Canada shall apply. The United Nations Convention on Contracts for the International Sale of Goods (CISG) is expressly excluded.

Informal resolution. Before any arbitration or court proceeding, the parties agree to first attempt in good faith to resolve any dispute through internal escalation to bazaar.catofficial@gmail.com within thirty (30) days.

Binding arbitration. Any dispute, claim, or controversy not resolved informally shall be finally resolved by binding arbitration administered under the rules of the ADR Institute of Canada, Inc. (ADRIC) for users in Canada, and under the JAMS Streamlined Arbitration Rules for users in the United States. The arbitration shall be conducted in English. For users in Canada, the seat of arbitration is Toronto, Ontario. For users in the United States, the seat of arbitration is Wilmington, Delaware. The arbitrator's award may be entered and enforced in any court of competent jurisdiction.

Class action and jury trial waiver. To the fullest extent permitted by law, each party agrees that any dispute will be brought only in the party's individual capacity and not as a class, collective, consolidated, or representative action. The parties expressly waive any right to a jury trial and to participate in a class action. If a court of competent jurisdiction finds the class action waiver unenforceable, then this arbitration provision shall be null and void only as to that dispute, which shall proceed in court.

Small claims and injunctive relief. Either party may bring an individual action in small claims court or equivalent, and may seek injunctive or other equitable relief in a court of competent jurisdiction to protect intellectual property, confidentiality, or security, without first arbitrating.

Limitation period. Any claim or cause of action must be commenced within one (1) year after the event giving rise to it, otherwise it is permanently barred.

17. Taxes, Customs, and Import Duties

Products are shipped internationally from suppliers. You are responsible for, and bazaar-cat is not liable for, any sales tax, use tax, goods and services tax (GST), harmonized sales tax (HST), Quebec sales tax (QST), provincial sales tax (PST), customs duties, import fees, brokerage charges, or other taxes or levies imposed by the United States, Canada, or any other jurisdiction. bazaar-cat does not collect or remit such taxes on behalf of users except where required by law. Delays or holds by customs authorities are not the responsibility of bazaar-cat.

18. Chargebacks and Fraud

You agree not to initiate a chargeback, payment reversal, or similar dispute with any card issuer, bank, or payment processor (including Stripe) regarding a transaction before first contacting bazaar-cat and allowing a reasonable opportunity to resolve the matter. Initiating a fraudulent or bad-faith chargeback, or providing false information to obtain a refund, constitutes a material breach of these Terms and may result in immediate account suspension, recovery of the disputed amount plus costs, and referral to authorities. bazaar-cat reserves the right to dispute any chargeback and to share transaction records, order evidence, and these Terms with card networks and processors.

19. Consumer Rights; Business Use

The store is intended for personal, household, and consumer use. Where applicable law (including Canadian provincial consumer protection statutes and U.S. state consumer protection laws) provides non-waivable rights to consumers, those rights are preserved to the fullest extent permitted and only if a court or tribunal determines that you qualify as a consumer. To the extent any provision is held unenforceable as to a consumer, it shall be enforced to the maximum extent permitted and the remainder of these Terms stays in full force.

20. Privacy and Data Protection

bazaar-cat collects and processes personal information in accordance with applicable privacy laws, including Canada's Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy laws, and U.S. federal and state privacy laws. By using the store you consent to the collection, use, storage, and cross-border transfer of your personal information for order fulfillment, payments, shipping, and service-improvement purposes. You may request access to or correction of your personal information by contacting bazaar.catofficial@gmail.com.

21. General Provisions

• Entire agreement: These Terms, together with referenced policies, constitute the entire agreement between you and bazaar-cat regarding the platform and supersede all prior or conflicting understandings.
• Severability: If any provision is held invalid or unenforceable, the remaining provisions remain in full force, and the invalid provision shall be modified to the minimum extent necessary to make it enforceable.
• No waiver: No failure or delay by bazaar-cat in enforcing any right is a waiver, and any waiver must be in writing to be effective.
• Assignment: You may not assign or transfer these Terms or your account without prior written consent. bazaar-cat may assign these Terms freely. Any unauthorized assignment is void.
• Survival: Provisions that by their nature should survive termination — including disclaimers, limitation of liability, indemnification, confidentiality, governing law/arbitration, and general provisions — remain in effect.
• No agency: These Terms do not create any partnership, joint venture, agency, or employment relationship between you and bazaar-cat.
• Headings: Section headings are for convenience only and do not affect interpretation.
• Export and sanctions compliance: You will not use the platform in violation of U.S. export controls (EAR, OFAC sanctions), Canadian export and sanctions controls, or any other applicable trade restrictions.
• Notices: Legal notices may be provided by email to your account address or by posting on the platform; such notices are deemed received upon sending or posting.
• Language: These Terms are provided in English. In Canada, the parties confirm that these Terms have been drawn up in English at the parties' wish. Les parties confirment que cette entente a été rédigée en anglais à leur souhait.

22. Changes to These Terms

We may update these terms from time to time. Continued use of the platform after changes constitutes acceptance of the revised terms.
