Bazaar-Cart Brand Ambassador Agreement

The complete terms binding every ambassador and Bazaar-Cart. Version 2026-11-08, updated November 8, 2026.

15% commission

On every sale made through your link, with no cap on what you can earn.

This Agreement is a legally binding contract. You sign it by typing your full legal name in the application, and we record the date and the version you accepted. Read every section before signing, and keep a copy for your records.

1. Parties and Acceptance

This Brand Ambassador Agreement ("Agreement") is a legally binding contract between you ("Ambassador", "you") and Bazaar-Cart ("Bazaar-Cart", "we", "us", "the Platform").

By submitting the ambassador application, typing your name as a signature, or earning commission under a referral code, you confirm that you have read, understood and agreed to every term below. If you do not agree, do not apply or promote the Platform.

The Agreement takes effect when Bazaar-Cart approves your application and continues until either party ends it under Section 12.

2. Definitions

"Ambassador Content" means every photo, video, story, post, caption, livestream, newsletter or other material you create that mentions, links to or shows the Platform or its products.

"Referral Code" means the unique code or link issued to you after approval.

"Referred Order" means a completed, paid and non-refunded order placed through your Referral Code.

"Commission" means the percentage of a Referred Order total that Bazaar-Cart pays you, as shown in your ambassador dashboard.

"Channels" means every social account, blog, newsletter or community you promote on, and which you list in your application with a working link.

3. Eligibility and Verification of Reach

You must have a combined, genuine audience of at least ten thousand (10,000) followers across the Channels you declare, and you must actively publish content to them.

Purchased, bot, incentivised, engagement-pod or otherwise artificially inflated followers are strictly prohibited. Bazaar-Cart may at any time request read-only analytics screenshots or platform insights to verify reach, audience location and engagement, and you agree to provide them within five (5) business days.

If any reach, engagement or endorsement you declare is found to be materially inaccurate or inflated, Bazaar-Cart may reject the application, terminate this Agreement immediately, withhold unpaid Commission and disqualify you from reapplying.

4. Your Channels and Links

You must list every Channel you use to promote Bazaar-Cart, each with a working public link and an accurate follower count. Concealing a Channel used for promotion is a material breach.

You must keep those links current in your ambassador profile. A Channel that goes private, is deleted, or stops posting for more than sixty (60) days may be removed from your declared reach and can affect your standing in the program.

Bazaar-Cart may display your Channels, follower counts and chosen products on your public ambassador profile.

5. Ambassador Content and Media Licence

You must upload photos or video frames of the content you actually use to promote brands so that we can review the quality and style of your work before approving you.

You keep ownership of all Ambassador Content. By submitting it, you grant Bazaar-Cart a worldwide, non-exclusive, royalty-free, transferable licence to host, reproduce, crop, edit, publish and display that content on the Platform, in email, on social media and in paid advertising, for as long as this Agreement is in force and for twelve (12) months afterwards for material already published.

You waive any moral rights in the Ambassador Content to the extent needed for that licence, and you confirm that you own or have licensed every element of it, including music, images and likenesses of other people.

You must not use another creator's content, stock footage you are not licensed to use, or AI-generated imagery that misrepresents a real product.

6. Mandatory Advertising Disclosure

Every piece of Ambassador Content must clearly and conspicuously disclose your material connection to Bazaar-Cart, in the post itself and not hidden in a hashtag wall, using clear language such as "#ad", "#sponsored" or "Bazaar-Cart ambassador".

You must comply with the U.S. Federal Trade Commission Endorsement Guides, the Canadian Competition Act and Ad Standards, and any equivalent rules in your own jurisdiction.

You may only make claims about products that are accurate and supported. You must not claim medical benefits, guaranteed results, or product features the listing does not state.

7. Brand Use and Trademark Licence

Bazaar-Cart grants you a limited, revocable, non-transferable licence to use its name, logo and product imagery solely to promote the Platform during the term of this Agreement.

You may not alter the logo, register or bid on Bazaar-Cart trademarks, domain names or confusingly similar terms in search or social advertising, or present yourself as an employee, agent or spokesperson with authority to bind Bazaar-Cart.

You may not create accounts, pages or handles that impersonate Bazaar-Cart or suggest an official storefront.

8. Commission, Tracking and Payouts

You earn 15% Commission (the standard program rate) on the product total of each Referred Order, excluding taxes, shipping and any amount later refunded. Where Bazaar-Cart sets a different rate for a specific ambassador, the rate shown in your dashboard applies.

Tracking relies on your Referral Code and a referral cookie. Bazaar-Cart does not guarantee credit for orders placed after the cookie expires, through a different device, through another creator's link, or with tracking blocked by the buyer.

Commission becomes payable when the order is delivered and the return window has passed, and is paid to the payout email on your ambassador profile, subject to a minimum payout balance set by Bazaar-Cart.

Bazaar-Cart may adjust the Commission rate on sixty (60) days' notice. A rate change never applies retroactively to orders already placed.

9. Refunds, Chargebacks and Clawback

If a Referred Order is refunded, cancelled, charged back or found to be fraudulent, the related Commission is reversed, whether or not it has already been paid.

If a reversal creates a negative balance, Bazaar-Cart may offset it against future Commission or invoice you for the difference.

Commission is earned only on genuine sales to third parties. Orders placed by you, your household, your employees or anyone acting on your behalf do not earn Commission.

10. Prohibited Conduct

The following are material breaches of this Agreement:

a) Self-referral, or organising others to place orders through your code with the intent to return them, farm Commission or manipulate ranking.

b) Posting fake reviews or testimonials, buying engagement, or using bots to amplify Ambassador Content.

c) Coupon-site, cashback-site or browser-extension injection of your Referral Code without our written approval.

d) Spam, unsolicited bulk messages, misleading giveaways, or promoting the Platform in adult, gambling, hateful or unlawful contexts.

e) Sharing customer names, addresses, order details or any non-public Platform information.

f) Registering or bidding on Bazaar-Cart brand terms in any ad platform.

If Bazaar-Cart reasonably believes you have engaged in any of the above, it may suspend your account immediately, void pending Commission, claw back paid Commission obtained through the conduct and pursue any further remedy available at law.

11. Public Conduct and Reputation

You represent Bazaar-Cart in public. You must not make disparaging, defamatory or knowingly false statements about Bazaar-Cart, its sellers, its products or its customers.

Genuine criticism and honest negative product feedback are always allowed and are never a breach. Raising a problem with our support team first is expected before publishing a public complaint about the business.

12. Term, Suspension and Termination

Either party may end this Agreement at any time on thirty (30) days' written notice. You may stop promoting at any time and remain eligible for Commission on orders placed before you stop.

Bazaar-Cart may suspend or terminate immediately, without notice, for fraud, breach of this Agreement, unlawful conduct, or behaviour that harms buyers, sellers or the Platform's reputation.

On termination you must stop using the Bazaar-Cart name and logo, remove or clearly mark existing Ambassador Content as no longer active, and stop presenting yourself as an ambassador.

Commission earned on genuine orders before termination is paid on the normal schedule, except where termination was for fraud, in which case all pending and paid Commission obtained through the fraud may be forfeited and recovered.

13. Confidentiality

Non-public information you receive as an ambassador, including unreleased products, discount codes, campaign plans, sales data and creator rates, is confidential.

You may not disclose it during the term or for two (2) years afterwards, except as required by law. This does not restrict honest disclosure to a government agency about unlawful conduct.

14. Audience and Customer Data

You may not collect, store or resell any buyer's personal information, and you may not run your own lookalike or retargeting audiences built from Platform customer data.

If you run giveaways or lead magnets that collect personal information about your audience, you are solely responsible for lawful collection, consent, storage and deletion under applicable privacy law.

15. Independent Contractor Status

You act as an independent contractor. Nothing in this Agreement creates an employment, agency, partnership or joint venture relationship.

You have no authority to make commitments or accept offers on behalf of Bazaar-Cart, and you are not entitled to employee benefits, expenses or reimbursement unless agreed in writing.

16. Taxes

You are solely responsible for declaring and paying all taxes on your Commission, including income tax and, where applicable, self-employment or GST/HST/QST obligations.

Bazaar-Cart may require a completed tax form (such as a W-9, W-8BEN or equivalent) before paying Commission, and may withhold amounts where the law requires it.

17. Intellectual Property and Complaints

All Bazaar-Cart trademarks, product photography, page copy and software remain the property of Bazaar-Cart or its licensors.

You must not copy Platform content for your own store, use it in competing marketplaces, or scrape product data.

If you believe content on the Platform infringes your rights, report it to support with the details needed to investigate.

18. Indemnification

You agree to indemnify and hold harmless Bazaar-Cart, its officers, employees and affiliates from any claim, damage, loss, penalty or legal fee arising from your Ambassador Content, your Channels, your breach of this Agreement, or your violation of advertising, privacy or consumer protection law.

This includes claims by third parties whose music, images or likeness you used without permission.

19. Limitation of Liability

Bazaar-Cart does not guarantee any level of traffic, sales or income. Commission figures shown in your dashboard are historical, not a forecast.

To the maximum extent permitted by law, Bazaar-Cart's total liability to you is limited to the Commission paid to you in the twelve (12) months before the claim, and it is not liable for indirect, incidental, special or consequential damages.

20. Modifications and Notices

Bazaar-Cart may update this Agreement. Material changes are communicated by email at least fourteen (14) days before they take effect, and the new version is published on this page.

Continuing to promote the Platform after the effective date means you accept the updated Agreement. If you do not accept it, end the Agreement under Section 12. Your signature records which version you accepted.

Notices to you go to the email address on your ambassador profile. Notices to us go to support.

21. Governing Law and Disputes

The parties will first attempt to resolve any dispute through good-faith negotiation within thirty (30) days of written notice.

If negotiation fails, the dispute will be resolved by binding individual arbitration rather than in court, and each party waives any right to a class action or class-wide arbitration.

This Agreement is governed by the laws of the United States and Canada as applicable to the ambassador's place of residence, without regard to conflict-of-law rules. Nothing here removes a consumer protection right you have that cannot be waived.

22. Electronic Signature and Entire Agreement

You agree to sign electronically and that typing your full legal name, together with the recorded date and agreement version, is your valid and binding signature under the U.S. E-SIGN Act, UETA and Canada's e-commerce legislation.

This Agreement, together with the Platform Terms of Service and Privacy Policy, is the entire agreement between you and Bazaar-Cart on this subject and replaces any earlier discussion.

If any provision is found unenforceable, the rest stays in force. Our failure to enforce a term on one occasion is not a waiver of it.

How to sign

Go back to the ambassador program, complete the application, then type your full legal name in the signature field and tick the acceptance box. Your signature is stored with the date and this version number.
